1. Terms & Conditions for our CLIENTS (i.e. if you book entertainment or other services through Ta-Daa!)
(scroll down for Terms & Conditions for performers)
- By booking a performer or other services through Ta-Daa! Professional Entertainment, it will be assumed that you agree with and accept these terms and conditions.
- When you use the services of Ta-Daa! Professional Entertainment to book a performer for an event, upon accepting our quote and booking the performer/s, Ta-Daa! Professional Entertainment will invoice you for a deposit (25% of the total fee quoted and agreed). This deposit will be payable within 14 days and will be non-refundable. Until the deposit is paid the performer is not 'locked in' or confirmed for the performance.
- If you do not wish to book any of the performers suggested by Ta-Daa! Professional Entertainment, or if no suitable performers are available for your event/function, Ta-Daa! Professional Entertainment will of course not charge a fee for service.
- In the unlikely event that a performer falls ill or for any other unforeseen reason is unable to attend a booked performance, Ta-Daa! Professional Entertainment will endeavour to arrange appropriate replacement entertainment. It is acknowledged that it is in the best interests of both our client and Ta-Daa! Professional Entertainment to ensure that every effort is made to ensure a satisfactory outcome for everyone.
- Notwithstanding the above, Ta-Daa! Professional Entertainment will not be held responsible or liable for any event outside its control which leads to the cancellation of a booked performance or an event.
- Cancellation by you, our client: If notice of a cancellation is received from you less than one week (7 calendar days) before a performance is due to commence, you will be liable for, and will be invoiced for, 100% of the agreed fee for service. Any deposit previously paid by you in relation to the booking will be subtracted from the balance owing. Ta-Daa!'s standard invoice payment terms (14 calendar days) will apply.
- Ta-Daa! Professional Entertainment does not provide public liability insurance or any other type of insurance for event organisers or for performers booked through our business. Responsibility for such insurances rests entirely with the event organiser and the performer.
- Following the performer's appearance in accordance with any relevant booking conditions (i.e. conditions which have been previously established in writing by you, the performer and Ta-Daa! Professional Entertainment), Ta-Daa! Professional Entertainment will invoice the event organiser for the balance of the agreed fee for service.
- All invoices presented by Ta-Daa! Professional Entertainment are to be paid by the event organiser within 14 calendar days of receipt - method of transmission is usually via email. If repeated efforts by Ta-Daa! to obtain payment for outstanding invoices are unsuccessful, Ta-Daa! will exercise the right to refer the matter to a commercial debt collection agency, after providing you with written (email) notification of such action being taken.
- Ta-Daa! Professional Entertainment reserves the right to refuse a booking request or enquiry from any event organiser or potential client in relation to finding and/or booking performers or in relation to providing any other requested services.
- COVID-safety: It is your responsibility to ensure that your event or activity is run in a COVID-safe manner, with appropriate hygiene, data collection and distancing protocols in place. A performer who is placed in a situation where COVID-safety protocols are not implemented and enforced may choose to leave the situation without any penalty. A performance that is cancelled due to an event organiser's failure to meet COVID-safe obligations will have no grounds to seek compensation or a refund for the booking.
2. Terms & Conditions for PERFORMERS
(i.e. if you are booked by Ta-Daa! to perform or provide other services for one of our clients)
- By accepting a booking (gig/performance) through Ta-Daa! Professional Entertainment, it will be assumed that you agree with and accept these terms and conditions.
- Ta-Daa! Professional Entertainment does not act as an agent or manager for specific performers and is not obliged to secure work for any performer. An event organiser is free to book any performer listed with Ta-Daa! Professional Entertainment, and Ta-Daa! Professional Entertainment is not responsible or liable in the event that any given performer is not booked.
- If for any reason a performer is unable to attend a booked performance, they are required to contact Ta-Daa! Professional Entertainment by telephone as soon as possible, and allowing sufficient time for alternative performers to be booked by Ta-Daa! Professional Entertainment. If a performer cancels a booked performance, they cannot claim any of the performance fee, even if they have accrued costs such as pre-paid travel or accommodation.
- If an event organiser (a client of Ta-Daa!) cancels a booked performance more than 7 calendar days before the performance is due to commence, 25% of the performer's agreed fee for that specific performance will be payable to the performer for compensation of the cancellation. If notice of a cancellation is received by Ta-Daa! Professional Entertainment from an event organiser less than 7 calendar days before a performance is due to commence, the event organiser will be charged 100% of the agreed fee, and the performer will be paid the full agreed performance fee to minimise financial loss resulting from a cancellation at short notice.
- Ta-Daa! Professional Entertainment will not be held responsible or liable for any event outside its control which leads to the cancellation of a booked performance or an event.
- Ta-Daa! Professional Entertainment does not provide public liability insurance or any other type of insurance for event organisers or for performers booked through our business. We strongly suggest that performers take out appropriate insurance to minimise relevant risks.
- Following the performer's appearance in accordance with any relevant booking conditions (i.e. conditions which have been previously established in writing by the event organiser (client), the performer and Ta-Daa! Professional Entertainment), the performer will invoice Ta-Daa! Professional Entertainment for the previously-agreed performance fee. The invoice will include the performer's ABN (if applicable), bank account details (for direct deposit) or postal address (for cheque payment), and will comply with all relevant requirements of the Australian Tax Office. Any GST payable must be clearly noted in the invoice. Invoices presented in accordance with these Terms and Conditions will be paid by Ta-Daa! Professional Entertainment within 28 calendar days.
charity policy
Ta-Daa! loves to support charities and non-profit organisations. We have always offered major discounts on our booking and other fees for charities so that larger profits from events can be returned to the charity. While we occasionally donate our services free of charge it is not possible to do this for all events without doing ourselves out of business. Given the impact of COVID on the Arts industry in general, it is becoming increasingly difficult to be as generous as we once were - however, do have a chat to us about what might be possible for your particular cause.
